Volunteer Release, Indemnity, Hold Harmless, and Assumption of Risk
READ CAREFULLY: THIS IS A LEGALLY BINDING AGREEMENT
Greenville County (“County”) is dedicated to keeping all volunteers safe. In consideration for participating in the
Greenville County Litter Ends Here or the Keep Greenville County Beautiful program (collectively, the “Programs”),
the undersigned individual and, if applicable, participating minors for whom the undersigned is the
parent or legal guardian (“Volunteer(s)”) acknowledge and agree to the following:
- Volunteer(s) agree to participate in the Programs, which involve voluntary litter cleanup activities. Volunteer(s) understand
that they are not County employees and they will receive no compensation of any kind
or receive any County benefits. Volunteer(s) have reviewed and signed the Volunteer Safety Protocol and
agree to follow those protocols and to generally perform Program activities in a responsible manner.
- Assumption of Risk: Volunteer(s) acknowledge that participation in these Programs involve certain risks,
including but not limited to accidents, injuries, property damage, and other potential hazards associated
with litter cleanup activities. Volunteer(s) voluntarily assume all risks associated with their participation in the
Programs.
- Release: Volunteer(s) waive their right to pursue and release and forever discharge the County, its officers,
employees, agents, and representatives, as well as Keep Greenville County Beautiful, and any participating
municipalities or other governmental entities and their respective officers, board members, employees,
agents, and representatives (collectively referred to as "Released Parties") for/from any and all claims,
demands, actions, causes of action, or liabilities of any kind arising out of or related to the Volunteer(s)’
participation in the Programs, including but not limited to personal injury, property damage, or any other
harm or loss, whether caused by the negligence of the Released Parties or otherwise.
- Indemnity and Hold Harmless: Volunteer(s) agree to indemnify, defend, and hold harmless the County
and the Released Parties from any and all claims, demands, actions, causes of action, losses, damages,
liabilities, costs, and expenses (including reasonable attorney fees) arising out of or related to the Volunteer(s)’
participation in the Programs, including but not limited to claims brought by third parties, whether
caused by the negligence of the Volunteer(s) or otherwise.
- Volunteer(s) understand that the activity associated with the Programs is physically strenuous, and Volunteer(s)
have no medical or other condition that will affect their safe participation in the Programs.
- Volunteer(s) authorize the County to obtain medical treatment for Volunteer(s) who require medical attention
with the Volunteer(s) being responsible for all costs related to any medical treatment or transportation.
Volunteer(s) release, forever discharge, and hold harmless the County from any claim whatsoever in
connection with such treatment or other medical services.
- Image and Voice Release: Volunteer(s) grant and convey to the County all right, title, and interest to all
photographs, images, videos, or recordings taken during the Volunteer(s)’ participation in the Programs.
- Volunteer(s) will not carry or possess weapons while participating in either of the Programs.
- This Agreement is binding on Volunteer(s) and their respective heirs, executors, administrators, legal representatives,
successors, and assigns.
- When this Agreement is executed by a parent/guardian on behalf of Volunteer(s) under the age of eighteen
(18) years, the undersigned parent/guardian hereby acknowledges and represents his or her unqualified
authority to execute the same on behalf of the minor(s) and agrees to hold harmless and indemnify the
Released Parties, and each entities’ officers, directors, agents, employees, and/or volunteers, from and
against any claims of such minor or his or her successors, and agrees to all terms and conditions of this
Agreement.
- If any term or provision of this Agreement is held to be invalid by any court, that term or provision shall be
deemed modified so as to be valid and enforceable to the full extent permitted. The invalidity of any such
term or provision shall not otherwise affect the validity or enforceability of the remaining terms and provisions
of this Agreement.
By signing below, Volunteer(s) acknowledge that they have read this Agreement, dully understood its
terms, and understand that I have given up substantial rights by signing it, and sign it freely and voluntarily
without inducement.
PARENT OR LEGAL GUARDIAN'S ADDITIONAL WAIVER AND INDEMNIFICATION
In consideration of the minor(s) listed below being allowed to participate as Volunteer(s) in either of the Programs, I agree to
waive the right to pursue and release, indemnify, and hold harmless the County for/from any and all claims brought by or on
behalf of the minor(s) listed below that are in any way related to their participation in activities of the Programs. I agree that
the minor(s) listed below and I are bound by all the terms and language of this Agreement and that the minor(s) are Volunteer(s)
as defined in the Agreement.
Volunteer Safety Protocol
As much as we value our County’s beauty, we value our citizens even more. All volunteers must follow these safety protocols.
Please review the following safety procedures with your group before the litter pickup.
Personal Safety
- Volunteers must wear closed-toed shoes. Long pants are recommended.
- Every group should have a first aid kit, water, sunscreen, bug spray and a cell phone onsite.
- Alcoholic beverages and illegal drugs are prohibited. Volunteers must be sober.
- Volunteers with prescribed medications that reduce reaction times are not allowed to participate.
- No weapons are allowed on a litter pickup.
- Do not engage in horseplay.
Traffic Safety
- Be alert and ready to react to traffic.
- Work together as a group and walk facing oncoming traffic. Work on one side of the road at a time.
- Everyone participating in the litter pickup up must wear a safety vest at all times.
- Don't wear headphones, as they interfere with hearing traffic.
- All volunteer cars must be parked off the road.
- Litter cleanups are not allowed to interrupt traffic.
- Litter pickups are prohibited in construction zones, on interstates, and roads with speed limits over 45mph.
Environmental Safety
- Watch out for potential natural hazards, such as bees, wasps, fire ants, snakes, poisonous plants.
- Litter pickups are not allowed during rain, fog, or any other weather that reduces visibility to drivers.
- Litter pickups are prohibited before sunrise and after sunset.
- Cleanup must be in the County of Greenville.
Litter Pickup Safety
- Don't handle hazardous litter, such as car batteries, discarded syringes, etc.
- Don't compress trash into the bags because sharp objects could cause injuries.
- Be very careful handling sharp objects.
- No pets are allowed at cleanups.
Minor Safety
- Children under the age of 12 years old must have their parent/guardian present during any cleanup alongside the roadway.
- There must be one adult present for every ten minors between the ages of 12-18.
- No children under the age of 5 are allowed to volunteer/participate in the Program.
Plan Ahead
- Check to make sure everyone has waivers signed before the event.
- Never give volunteer supplies, or allow someone to volunteer who has not signed a waiver.
- Drive the route before cleanup to note any safety concerns or blind spots.
- Alter the cleanup plan and route if any safety concerns are noted.
- Never hold a cleanup during rush hour. If cleanup is near a school, don't hold a cleanup during student arrival or departure times.
By my signature, I acknowledge that I have read, understand and agree to abide by the terms of
this Volunteer Safety Protocol and I further agree to NOT hold Greenville County, Greenville County Municipalities, the
Greenville County Litter Prevention Coordinator or his/her sponsor(s) responsible for any injuries or damages suffered,
as a result of my participation in the Greenville County Litter Ends Here Program.
