Mediation is a voluntary and informal process in which a neutral person helps the parties discuss settlement. Any settlement is voluntary. In a mediation, the parties themselves decide whether and how to settle the dispute.
In the Probate Court, mediation has been useful in resolving issues about how the property of incompetent persons should be managed and how the estates of deceased persons should be handled and distributed. Contact the Probate Court for more information on this service.
